2. Purpose and Acceptance of the Terms
These Terms and Conditions of Sale (the “Terms”) govern the online sale of products offered on the Site (the “Products”) to consumers (the “Customer”).
Before placing an order, the Customer acknowledges having read and accepted these Terms.
The validation of an order constitutes full and unconditional acceptance of the Terms in force on the date of the order.
Les Sœurs de Noé reserves the right to amend these Terms at any time. The version applicable to an order is the version in force on the date the order is placed.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.
Language Versions
These Terms may be translated into several languages for the convenience of international Customers.
In the event of any discrepancy or inconsistency between a translated version and the English version, the English version shall prevail and be legally binding.
3. Products
3.1 Product Characteristics
Each Product is accompanied by a description outlining its principal characteristics, ingredients and olfactory profile.
Product photographs, videos, illustrations and other visual representations are provided for illustrative purposes only and are not contractually binding.
Minor variations in color, packaging, presentation or appearance may occur and shall not constitute a defect or non-conformity.
3.2 Product Use
Les Sœurs de Noé fragrances are cosmetic products intended exclusively for external use.
Customers are encouraged to carefully review the ingredient list before use and to perform a skin test, particularly in cases of sensitive skin, allergies or known sensitivities.
Les Sœurs de Noé shall not be liable for damages resulting from misuse of the Products, failure to follow usage instructions or individual allergic reactions, except where the Product is proven to be defective or non-compliant under applicable law.
3.3 Compliance
The Products comply with applicable European cosmetic regulations, including Regulation (EC) No. 1223/2009, as well as all applicable consumer safety requirements.
3.4 Availability
Products are offered subject to availability.
If a Product becomes unavailable after an order has been placed, the Customer will be informed as soon as reasonably possible and will be offered either:
- a refund of the unavailable Product; or
- an alternative solution where applicable.
4. Prices and Taxes
All prices displayed on the Site are expressed in euros (EUR).
Prices may be modified at any time without prior notice. Products will be invoiced based on the prices displayed at the time the order is confirmed.
4.1 European Union
For deliveries within the European Union, prices include Value Added Tax (VAT) in accordance with applicable European regulations.
4.2 Outside the European Union
For deliveries outside the European Union, import duties, local taxes, customs charges, administrative fees or other governmental charges may apply depending on the destination country.
Unless otherwise indicated at checkout, such charges remain the sole responsibility of the Customer.
4.3 DDP Destinations
Where indicated at checkout, orders to certain destinations, including the United States, Canada and the United Kingdom, may be shipped DDP (Delivered Duty Paid).
In such cases, applicable import duties, taxes and customs clearance charges are included in the amount paid at checkout.
Les Sœurs de Noé reserves the right to modify DDP destinations, taxes, shipping methods and pricing conditions at any time.
4.4 Pricing Errors
Despite our best efforts, pricing errors may occasionally occur.
Les Sœurs de Noé reserves the right to refuse, cancel or refund any order resulting from an obvious pricing error, technical malfunction or system error.
5. Orders
To place an order, the Customer must select the desired Products, add them to the shopping cart, provide delivery information and select a payment method.
Before final confirmation, the Customer may review and modify the order details.
An order shall only become binding once payment has been successfully authorized and accepted.
Les Sœurs de Noé reserves the right to refuse, suspend or cancel any order for legitimate reasons, including but not limited to:
- suspected fraud;
- payment incidents;
- chargeback risks;
- unusually large quantities;
- suspicious purchasing behavior;
- inaccurate customer information;
- technical errors affecting the order.
Fraud Prevention
Les Sœurs de Noé reserves the right to request additional verification documents before shipping an order where fraud, unauthorized payment activity or misuse of promotional offers is suspected.
Failure to provide the requested information may result in the cancellation of the order and a refund of the payment.
6. Payment
Payment is due immediately upon placing the order.
Payments are processed through secure providers including Shopify Payments, Stripe, PayPal, Shop Pay, Apple Pay, Google Pay, Bancontact, iDEAL and any other payment methods displayed at checkout.
The Site uses SSL encryption technology and industry-standard security measures to protect payment information.
Les Sœurs de Noé does not store complete credit card information on its servers.
Orders remain the property of Les Sœurs de Noé until full payment has been received.
7. Delivery
Orders are prepared and shipped from our logistics warehouse located in France.
Deliveries are carried out by recognized carriers such as Colissimo, Chronopost, FedEx or equivalent carriers depending on the destination.
Delivery times are estimates only and may vary due to destination country, customs procedures, carrier operations, public holidays, peak periods or other circumstances beyond our reasonable control.
Les Sœurs de Noé shall not be liable for delays resulting from:
- carrier delays;
- customs inspections;
- governmental actions;
- logistical disruptions;
- force majeure events;
- inaccurate information provided by the Customer.
To the fullest extent permitted by law, the liability of Les Sœurs de Noé shall be limited to the amount actually paid for the relevant order.
Customer Responsibility for Delivery Information
The Customer is solely responsible for providing complete, accurate and up-to-date delivery information.
Les Sœurs de Noé shall not be responsible for delays, losses, returns, additional transport costs, storage fees, customs charges or delivery failures resulting from inaccurate, incomplete or outdated information supplied by the Customer.
If a parcel is returned due to incorrect address information, refusal of delivery, repeated absence, failure to collect the parcel or any other circumstance attributable to the Customer, any refund may be reduced by:
- shipping costs;
- return shipping costs;
- customs duties;
- administrative fees;
- storage charges;
- any other costs incurred by Les Sœurs de Noé.
If the Customer requests a reshipment, additional shipping charges may apply.
Shipping Fees
Shipping fees are automatically calculated based on the Products ordered and the delivery destination.
The applicable fees are displayed:
- in the cart;
- during checkout;
- before final order confirmation.
European Union
Les Sœurs de Noé offers complimentary standard shipping on all orders within the European Union unless otherwise stated on the Site.
International Destinations
For deliveries outside the European Union:
- complimentary standard shipping is offered on orders above €200;
- orders below €200 are subject to the shipping fees displayed at checkout.
Les Sœurs de Noé reserves the right to modify shipping fees, thresholds and delivery conditions at any time.
The applicable conditions are those displayed at the time the order is placed.
Refused or Uncollected Parcels
If a parcel is refused, unclaimed or returned to sender for reasons attributable to the Customer, Les Sœurs de Noé reserves the right to:
- deduct return costs, transport costs, customs charges and administrative fees from any refund; or
- charge additional shipping fees for a reshipment.
8. Damaged Products
The Customer must inspect the parcel upon delivery.
In the event of a damaged, defective or non-conforming Product, the Customer must contact customer service within 48 hours of delivery and provide:
- photographs of the parcel;
- photographs of the Product;
- photographs of the shipping label;
- any additional information reasonably requested.
Claims submitted after this period may not be accepted.
Where a claim is validated, Les Sœurs de Noé may, at its discretion and in accordance with applicable law:
- replace the Product;
- issue a refund; or
- provide another appropriate remedy.
9. Lost, Stolen or Marked-as-Delivered Parcels
If a parcel is marked as delivered by the carrier, Les Sœurs de Noé cannot automatically be held responsible for any loss, theft or misplacement occurring after delivery.
Customers are encouraged to:
- verify the delivery address provided at checkout;
- check with household members, neighbors or reception services;
- contact the carrier directly for additional delivery information.
Where appropriate, Les Sœurs de Noé may open an investigation with the carrier.
Once a parcel has been marked as delivered by the carrier, Les Sœurs de Noé may require the Customer to cooperate fully with any carrier investigation before any replacement, compensation or refund can be considered.
The Customer agrees to provide any documentation reasonably requested, including declarations, photographs or communications with the carrier.
To the fullest extent permitted by law, Les Sœurs de Noé shall not be responsible for parcels lost or stolen after confirmed delivery by the carrier.
Chargebacks and Payment Disputes
In the event of a chargeback, payment dispute or unauthorized transaction claim, Les Sœurs de Noé reserves the right to provide the relevant payment provider, bank or dispute resolution body with all information reasonably necessary to contest the claim, including:
- order records;
- delivery confirmations;
- tracking information;
- correspondence with the Customer;
- fraud prevention records.
Fraudulent or abusive chargebacks may result in refusal of future orders.
10. Right of Withdrawal
In accordance with Directive 2011/83/EU and applicable consumer protection legislation, Customers have the right to withdraw from their purchase within fourteen (14) calendar days from receipt of the Products without providing any reason.
To exercise this right, the Customer must notify Les Sœurs de Noé of their decision before the withdrawal period expires.
Returned Products must be:
- unused;
- unopened;
- in their original packaging;
- complete and in perfect resale condition.
Return shipping costs remain the responsibility of the Customer unless otherwise required by applicable law.
Refunds will be processed within ten (10) business days following receipt and inspection of the returned Products.
Refunds will be issued using the original payment method whenever possible.
Exclusion of the Right of Withdrawal
For reasons of hygiene, health protection and product integrity, the right of withdrawal does not apply to:
- opened fragrances;
- opened samples;
- Discovery Sets that have been opened or used;
- any Product whose protective seal has been removed after delivery.
Nothing in this section affects mandatory consumer rights under applicable law.
11. Complimentary Samples
Subject to availability, Les Sœurs de Noé may offer complimentary fragrance samples with eligible purchases.
Current sample allocations are as follows:
- Purchase of one eligible Product (Discovery Set, 20 ml or 100 ml): up to two (2) complimentary samples.
- Purchase of two (2) or more eligible Products: up to four (4) complimentary samples.
Sample selections are subject to stock availability.
If a selected sample is unavailable, Les Sœurs de Noé reserves the right to substitute it with a similar or equivalent sample without prior notice.
Complimentary samples have no cash value, are non-transferable and cannot be exchanged or refunded.
12. Discovery Sets and Discount Vouchers
The purchase of a Discovery Set or a set of eight (8) samples entitles the Customer to receive a €50 discount voucher.
The voucher:
- is valid for thirty (30) days from the date of issue;
- is valid on orders of €150 or more;
- is single-use only;
- is non-transferable;
- is non-refundable;
- cannot be exchanged for cash;
- cannot be combined with other discount codes, promotional offers or vouchers unless expressly stated otherwise.
The voucher is generally sent electronically following confirmation of the order.
Les Sœurs de Noé reserves the right to cancel, refuse or deactivate a voucher in cases of fraud, abuse, technical error or misuse.
13. Promotional Codes
Promotional codes may occasionally be offered by Les Sœurs de Noé.
Unless otherwise specified:
- only one promotional code may be used per order;
- promotional codes cannot be combined;
- promotional codes cannot be exchanged for cash;
- promotional codes may be limited by date, quantity, territory or specific Products.
Promotional codes cannot be applied retroactively to orders already placed.
Les Sœurs de Noé reserves the right to modify, suspend or cancel any promotional code in cases of fraud, abuse, technical malfunction or pricing error.
14. Gift Cards
Digital gift cards are available for purchase on the Site.
Gift cards:
- are delivered electronically;
- are non-refundable;
- cannot be exchanged for cash;
- are valid exclusively on www.lessoeursdenoe.com;
- may not be used to purchase additional gift cards.
Gift cards remain the responsibility of the purchaser and recipient.
Les Sœurs de Noé shall not be liable for lost, stolen, deleted or unauthorized use of gift cards once issued.
15. Intellectual Property
All content available on the Site, including but not limited to:
- trademarks;
- logos;
- product names;
- texts;
- photographs;
- videos;
- graphics;
- packaging designs;
- visual identity elements;
- website content;
is the exclusive property of Les Sœurs de Noé and/or its licensors and is protected by applicable intellectual property laws.
Any reproduction, distribution, modification, publication, transmission or use of such content without prior written authorization is strictly prohibited.
Nothing contained on the Site shall be interpreted as granting any license or right to use any intellectual property belonging to Les Sœurs de Noé.
16. Personal Data and Customer Accounts
Personal data is processed in accordance with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679) and applicable privacy legislation.
For detailed information regarding the collection, use and protection of personal data, Customers should consult the Privacy Policy available on the Site.
Customer Accounts
Customers may create an account to facilitate future purchases and access certain features of the Site.
Customers creating an account are solely responsible for maintaining the confidentiality of their login credentials and for all activities conducted through their account.
Customers agree to notify Les Sœurs de Noé immediately of any unauthorized use of their account or any security breach.
Les Sœurs de Noé reserves the right to suspend or terminate any account in cases of suspected fraud, misuse, unlawful activity or violation of these Terms.
17. Legal Warranty
Customers benefit from all mandatory legal warranties provided under applicable consumer protection laws, including:
- the legal guarantee of conformity;
- protection against hidden defects;
- any other statutory consumer rights applicable in the Customer's country of residence.
Where a Product is proven to be non-conforming or defective under applicable law, the Customer may be entitled to repair, replacement, price reduction or refund, subject to the conditions provided by law.
Nothing in these Terms shall limit or exclude any mandatory consumer rights that cannot legally be waived.
18. Disputes and Mediation
In the event of any complaint or dispute, Customers are invited to first contact Les Sœurs de Noé at:
Les Sœurs de Noé will make reasonable efforts to resolve disputes amicably and in good faith.
European consumers may also use the Online Dispute Resolution platform provided by the European Commission:

The use of mediation remains voluntary unless otherwise required by applicable law.
19. Governing Law and Jurisdiction
These Terms and any contracts entered into through the Site shall be governed by and construed in accordance with Belgian law.
Any dispute relating to the interpretation, validity, performance or termination of these Terms shall be submitted to the competent courts of Brussels, Belgium, unless mandatory consumer protection rules provide otherwise.
Nothing in these Terms shall deprive consumers of the protection granted by mandatory provisions of the law applicable in their country of residence.
20. Force Majeure
Les Sœurs de Noé shall not be held liable for any failure, delay or inability to perform its obligations where such failure results from circumstances beyond its reasonable control.
Such circumstances may include, without limitation:
- natural disasters;
- floods;
- fires;
- earthquakes;
- epidemics or pandemics;
- war;
- terrorism;
- civil unrest;
- governmental restrictions;
- customs restrictions;
- strikes or labor disputes;
- transportation disruptions;
- energy shortages;
- cyberattacks;
- telecommunications failures;
- carrier disruptions;
- supply chain interruptions.
The performance of affected obligations shall be suspended for the duration of the force majeure event.
21. Electronic Communications
By using the Site, creating an account or placing an order, the Customer agrees to receive communications electronically.
Such communications may include:
- order confirmations;
- payment confirmations;
- shipping notifications;
- customer service communications;
- returns information;
- legal notices;
- account-related messages.
The Customer acknowledges that electronic communications satisfy any legal requirement that such communications be made in writing.
Marketing communications remain subject to applicable consent requirements and may be withdrawn at any time.
22. Customer Reviews and User Content
Customers may be given the opportunity to submit reviews, comments, testimonials, photographs or other content on the Site or through affiliated services.
By submitting such content, the Customer confirms that:
- the content is accurate and genuine;
- the Customer owns or controls the necessary rights;
- the content does not infringe the rights of any third party;
- the content is not unlawful, defamatory, misleading, abusive, fraudulent, discriminatory or offensive.
Les Sœurs de Noé reserves the right, at its sole discretion, to:
- review submitted content;
- refuse publication;
- remove content;
- moderate content;
- investigate suspicious reviews.
Les Sœurs de Noé may remove reviews suspected to be:
- fraudulent;
- misleading;
- generated by automated systems;
- submitted in exchange for undisclosed compensation;
- otherwise inconsistent with applicable laws or platform policies.
By submitting content, the Customer grants Les Sœurs de Noé a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, display and distribute such content for marketing, communication and promotional purposes, unless otherwise agreed in writing.
